User Agreement

This User Agreement (the "Agreement") is a legal agreement between You (the "User" or "You") and FreshVault ("FreshVault," "we," "us," or "our"), operating under the domain lumoset.top. This Agreement, together with our Terms of Service and Privacy Policy, governs Your use of the FreshVault website and all related services (collectively, the "Service").
By accessing, browsing, registering, or otherwise using the Service, You acknowledge that You have read, understood, and agree to be bound by this Agreement. If You do not agree to any provision of this Agreement, You must not access or use the Service.
Important Notice — Google AdSense & Third-Party Advertising: FreshVault participates in Google AdSense and other third-party advertising programs. These partners may use cookies, web beacons, IP addresses, and other identifiers to collect information about Your activity on this and other websites. This Agreement contains specific provisions (Sections 3–9) to ensure full compliance with Google Publisher Policies, the EU User Consent Policy, and applicable data protection laws.

1. Acceptance & Definitions
By using the Service, You represent and warrant that:
- You have the legal capacity and authority to enter into this Agreement.
- You are at least 13 years of age (or the minimum age required for digital consent in Your jurisdiction, such as 16 in certain EU member states).
- Your use of the Service does not violate any applicable law or regulation.
Definitions: "Google" refers to Google LLC. "AdSense" refers to the Google AdSense advertising service. "PII" refers to Personally Identifiable Information as defined under applicable data protection laws. "EEA" refers to the European Economic Area. "Cookies" includes cookies, web beacons, pixels, local storage, and similar tracking technologies.
2. User Eligibility
The Service is intended for users who are at least 13 years of age. If You are under 18, You represent that Your parent or legal guardian has reviewed and agreed to this Agreement on Your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, in accordance with the Children's Online Privacy Protection Act (COPPA) and equivalent laws.
3. Google AdSense & Third-Party Advertising
FreshVault participates in the Google AdSense program and may display advertisements provided by Google and other third-party advertising networks. In accordance with Google Publisher Policies, we disclose the following to You:
- Third-party vendors, including Google, may use cookies and similar technologies to serve ads based on Your prior visits to this and other websites.
- Google's use of advertising cookies enables it and its partners to serve ads to You based on Your visit to our Service and other sites on the Internet.
- You may opt out of personalized advertising by visiting the links provided in Section 6 of this Agreement.
- Third parties may place and read cookies in Your browser, or use web beacons or IP addresses to collect information, as a result of the display of advertisements on our Service.
- The information collected may include Your IP address, browser type, device information, pages visited, time spent, and other usage data.

4. Cookie Consent & EU User Consent Policy
In compliance with the Google EU User Consent Policy, which applies to users located in the European Economic Area (EEA), the United Kingdom, and Switzerland, we are required to obtain Your legally valid consent before:
- Storing or accessing information on Your device (using cookies or other local storage technologies), where required by law.
- Collecting, sharing, and using Your personal data for ad personalization by Google, our advertising partners, and other third parties.
Specifically, we commit to the following consent requirements:
- We will obtain and retain a record of Your consent before processing personal data for advertising purposes.
- We will provide You with clear and accessible instructions for withdrawing consent at any time.
- We will clearly identify each party that may collect, receive, or use Your personal data as a result of Your use of our Service, including Google and our advertising partners.
- We will provide You with prominent and easily accessible information about how each party uses Your personal data.
- If third-party assets integrated into our Service result in personal data being shared with Google, we will use commercially reasonable efforts to ensure those third parties comply with the same consent obligations.

5. Data Collection & Sharing Disclosure

When personalized advertising is enabled, Google uses information from Your activity on our Service and other sites to display ads that are relevant to Your interests. When You opt out, You will still see advertisements, but they will no longer be based on Your interests or browsing behavior. Opting out applies only to participating advertising networks and does not prevent all personalized advertising.
Note: If You opt out and later delete or clear Your cookies, You will need to opt out again. Different browsers and devices maintain separate settings, so You may need to manage preferences on each device You use.

To fulfill our disclosure obligations regarding how Google uses data collected from our Service, we provide a prominent link to Google's official privacy disclosure for partner sites. This link explains how Google and its partners use data to serve ads, measure performance, and prevent fraud when You visit our Service:

8. Personally Identifiable Information (PII)
In strict compliance with Google Publisher Policies regarding user identification, we adhere to the following rules:
- We do not pass to Google any data that could be used as or to identify Personally Identifiable Information (PII).
- We do not merge personal information with previously collected non-personal information unless we have provided prior notice and obtained Your explicit consent (opt-in).
- If we intend to identify users or merge PII with non-PII, we will provide sufficient advance notice and obtain Your explicit consent before doing so.
- We do not attempt to disaggregate or de-anonymize aggregated data in Google reports, regardless of whether we have obtained Your consent.
- We comply with the Google EU User Consent Policy for all users in the EEA, UK, and Switzerland.
9. Device & Location Data
If the Service collects, processes, or discloses precise geographic location information (such as GPS, Wi-Fi, or Bluetooth-derived location data), we adhere to the following requirements in accordance with Google Publisher Policies:
- We disclose the collection, processing, and disclosure of such location data in all applicable privacy policies, including this Agreement and our Privacy Policy.
- We provide interstitial or in-the-moment notifications to users disclosing the potential uses of such data, which may include ad personalization, analytics, and attribution.
- We obtain the end user's explicit consent (opt-in) before collecting, processing, or disclosing such information.
- We send such information to Google in encrypted form or through an encrypted channel.
10. Children's Online Privacy (COPPA)
In compliance with the Children's Online Privacy Protection Act (COPPA) and Google Publisher Policies regarding child-directed content:
- The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent.
- If our Service or any portion of it is determined to be child-directed, we will notify Google through Google Search Console or by using the AdMob SDK/tag to mark the content as child-directed.
- We do not serve interest-based advertising to users under 13 or to users of child-directed sites, apps, or services.
- If You believe a child has provided us with personal information without parental consent, please contact us immediately at [email protected], and we will take steps to delete such information.
11. Prohibited Uses & Content Standards
To comply with Google Publisher Content Policies and to maintain the integrity of the Service, the following content and behaviors are strictly prohibited:
- Illegal content: Content that is illegal, promotes illegal activity, or infringes upon the legal rights of others.
- Intellectual property abuse: Infringing copyright or promoting counterfeit goods.
- Dangerous or derogatory content: Content that incites hatred, discrimination, harassment, or promotes physical or mental harm.
- Misrepresentation: Misrepresenting or falsely claiming the identity or affiliation of the publisher, or engaging in deceptive practices such as phishing, bait-and-switch, or disguised content.
- Enabling dishonest behavior: Content that facilitates cheating, fraud, hacking, unauthorized surveillance, or the creation of fake documents.
- Adult content: Sexually explicit content, including child sexual abuse material (CSAM), which is strictly prohibited and reported to authorities.
- Circumventing ad fraud: Any activity designed to artificially inflate ad impressions, clicks, or conversions, including click fraud, bot traffic, or incentivized clicks.
- Malware or unwanted software: Distributing or facilitating the distribution of malware, spyware, or software that violates Google's Unwanted Software Policy.
Users who violate these standards may have their access terminated immediately, and we may report violations to Google and relevant authorities.
12. Ad Inventory Authorization (ads.txt)
In compliance with Google Publisher Policies regarding authorized digital sellers, we maintain a valid ads.txt file at the root of our domain (accessible at https://lumoset.top/ads.txt) that:
- Lists ourselves (FreshVault) as an authorized seller of our ad inventory.
- Lists Google (AdSense) and other authorized ad networks as authorized sellers.
- Is kept up to date to ensure only authorized parties can sell our inventory.
13. Better Ads Standards
We comply with the Coalition for Better Ads Standards to ensure a positive ad experience for our users. Specifically:
- We do not display ads in formats that are identified by the Coalition for Better Ads as being highly annoying or disruptive to users.
- Ads do not overlap with navigation elements or cause unintended clicks.
- Ads do not prevent users from exiting or navigating the Service.
- The ratio of ad space to publisher content does not exceed reasonable proportions, ensuring content remains the primary focus.
- Ads are contextually relevant and are clearly distinguishable from our content.
14. Sanctions Compliance
In accordance with Google Publisher Policies and applicable laws, we comply with applicable trade and economic sanctions programs, including those administered by the U.S. Office of Foreign Assets Control (OFAC). Users located in, or who are residents of, sanctioned countries or regions (which may include but are not limited to Crimea, Cuba, Iran, North Korea, and Syria) or who are on restricted party lists, are not permitted to use the Service or access Google Publisher products through our Service. We do not act on behalf of any restricted party.
15. Consent Records & Data Retention
In compliance with the Google EU User Consent Policy, we maintain the following consent management practices:
- Consent Records: We retain a record of Your consent decisions, including the date, time, scope of consent, and the version of the consent notice You agreed to.
- Withdrawal Mechanism: We provide clear and accessible instructions for withdrawing consent at any time, including cookie management settings and the opt-out links listed in Section 6.
- Data Retention: Personal data collected through cookies and similar technologies is retained in accordance with our Privacy Policy and applicable law. Analytics data is typically retained for up to 26 months, after which it is aggregated or anonymized.
- Third-Party Compliance: If third-party assets integrated into our Service result in personal data being shared with Google, we use commercially reasonable efforts to ensure those third-party operators comply with the same consent obligations.
16. Changes to This Agreement
We reserve the right to modify this Agreement at any time. When we do, we will update the "Last Updated" date at the top of this page. If we make material changes, we will provide notice on the Service or, where appropriate, via the email associated with Your account, before the changes take effect.
Your continued use of the Service after the revised Agreement becomes effective constitutes Your acceptance of the updated terms. If You do not agree to the modified Agreement, You must stop using the Service before the changes take effect.
17. Termination
We may suspend or terminate Your access to the Service at any time, without prior notice, if You violate this Agreement, our Terms of Service, or Google Publisher Policies, or for any other reason at our sole discretion. Upon termination, all provisions of this Agreement that by their nature should survive termination shall survive, including those relating to intellectual property, liability limitations, and governing law.
